法律執業者及法律學者︰就四位立法會議員被褫奪資格的聲明


2020年11月11日,全國人大常委會通過決議(下稱「人大決定」),指示香港特區政府在某些情況下可褫奪立法會議員的資格。特區政府隨即宣佈褫奪楊岳橋、郭家麒、郭榮鏗及梁繼昌這四位立法會議員的資格,聲稱認為這四位立法會議員(i)主張或支持「港獨」;(ii)拒絕承認中國擁有香港主權;(iii)尋求外國干預香港事務;(iv)危害國家安全;及(v)不符合擁護《基本法》和效忠香港特區行政區的要求。(下稱「政府公告」)

我們以法律執業者及法律學者的個人名義,對香港的法治情況表達深切的關注。我們有責任指出,人大決定和政府公告褫奪四位立法會議員的資格,是違反法治、「一國兩制」原則、《基本法》第79條的規定、《基本法》保障的政治權利和自由,以及程序公義。

除此之外,立法會議員是市民的代表,絕不能單由行政機關褫奪其資格,否則政治參與的權利必遭嚴重剝奪。

此外,人大決定和政府公告褫奪該四位立法會議員的資格,乃認為由於在6月30日前,即國安法生效前,他們的行為不符合國安法的規定。這樣表示國安法有追溯力,違反憲制原則和國際標準。

法治原則是香港成功的基石,全賴它防止權力的肆意運用,以維護市民的權利。法治亦體現於公平地管治社會,市民的權利和自由得到保障。我們促請中國和香港政府尊重法治原則,不可以政治凌駕法治。

Statement on the disqualification of four Legislative Council members

The NPCSC passed a resolution on 11 November 2020 directing HKSAR Government to disqualify Legislative Council members under certain circumstances (the “Decision”), after which the government immediately made an announcement to disqualify four legislators, Alvin Yeung, Kwok Ka-ki, Kenneth Leung and Dennis Kwok. The claim was that they are deemed to have (i) advocated or supported “Hong Kong independence“; (ii) refused to admit China’s sovereignty over the HKSAR; (iii) sought foreign interference in Hong Kong affairs; (iv) endangered national security; and (v) failed to uphold the Basic Law and pledged allegiance to the HKSAR (the “Announcement”).

We, the undersigned in our personal capacity, as solicitors and legal academics deeply concerned about the Rule of Law in Hong Kong, we feel duty bound to express our view that the Decision and the Announcement to disqualify the four legislators are contrary to the Rule of Law, the principle of “one country, two systems”, the express provisions of Article 79 of the Basic Law, the constitutional rights and freedoms guaranteed by the Basic Law, as well as due process.

Among other things, legislators are representatives of the people who must not be unseated by the executive branch alone; otherwise the right of political participation would be seriously abrogated.

Further, the legislators have been disqualified by taking into account their conduct which happened before the National Security Law came into effect on 30 June 2020 for their alleged failure to comply with requirements related thereto. The requirements are therefore applied retroactively, contrary to constitutional principles and international standards.

The principle of rule of law is the cornerstone of Hong Kong’s success because it guards us against arbitrary exercise of power. The rule of law also embodies a commitment to govern society by rules fairly, whereby the rights and freedoms of citizens can be protected. We urge the Chinese and Hong Kong authorities to respect the rule of law and not to override the rule of law with politics.
